When written buyer agreements are required, compensation language, negotiability disclosures, scope, term and signed-copy requirements.
Clear Cooperation & Listing Marketing
Operational guidance for MLS submission, public marketing and seller-directed listing options.
Core Rule
Under NAR Clear Cooperation Policy, a listing that is publicly marketed generally must be submitted to the MLS for cooperation within one business day, subject to the applicable local MLS rules and permitted exemptions.
What Can Count as Public Marketing
Public marketing can include yard signs, public-facing websites, brokerage website/IDX/VOW displays, email blasts, multi-brokerage listing-sharing networks, public apps and other marketing available to the public.
Office Exclusive / Delayed Marketing
Use only when permitted by the local MLS and supported by the required seller certification/disclosure. Local MLS filing deadlines and procedures control.
Do not use “coming soon,” private-network, office-exclusive, delayed-marketing or off-market strategies to circumvent MLS rules, fair-housing obligations or the seller’s informed instructions.
NAR Clear Cooperation
NAR Listing Options for Sellers
Do Not Call, Do Not Text & Do Not Contact
Operational prospecting safeguards for consumer calls, texts and suppression requests.
Before Outreach
Follow brokerage-approved screening procedures for the National Do Not Call Registry, Achieve Realty’s entity-specific Do Not Call / Do Not Contact records, applicable consent requirements and state restrictions.
Registry Refresh
For covered telemarketing calls, National Do Not Call data used for calling campaigns must be refreshed at least every 31 days. A public phone number, lead list or data-service record is not by itself permission to call or text.
Honor Stop Requests
If a consumer says “do not call,” “stop,” “remove me,” “unsubscribe,” or otherwise clearly asks to stop or limit contact, record the request in the CRM/suppression system and stop the applicable marketing outreach.
Automated Calls & Texts
Automated calls, prerecorded/artificial voice calls, robotexts and mass texting require separate TCPA/FCC review before use. When in doubt, treat a clear request not to be contacted as a Do Not Contact instruction.
FTC Do Not Call / TSR
FCC Calls & Texts
Required Written Buyer Representation Agreements
Operational guidance for written buyer agreements and compensation disclosures.
Before Touring
MLS Participants working with a buyer must enter into a written agreement with the buyer before touring a home when required by NAR MLS policy, unless inconsistent with state or federal law/regulation. Achieve agents must use the current brokerage-approved agreement applicable to the transaction.
Compensation
The agreement must clearly address services and compensation. Compensation must be objectively ascertainable, may not be open-ended, and the agreement must prevent receipt of more compensation for brokerage services than the buyer agreed to.
Negotiability & Agreement Terms
The agreement must conspicuously state that broker fees and commissions are not set by law and are fully negotiable. Explain scope, term, exclusivity/non-exclusivity and termination provisions accurately, and give the buyer a signed copy.
NAR Policy 8.13

Expired Listing Scripts
Achieve Realty conversation frameworks for respectful, prepared and seller-focused expired-listing prospecting.
1. First Call — Seller-First Opening
Purpose: Find out whether selling is still part of the homeowner's plan before offering a solution.
Achieve framework:
“Hi [Name], this is [Your Name] with Achieve Realty. I noticed your home recently came off the market. I’m not calling to assume you still want to sell—I wanted to ask whether moving is still part of your plan, or whether your plans have changed.”
If they are still considering a sale: “When you look back at the last listing, what do you feel would need to be different for you to try again?”
Goal: Listen for motivation, timing, frustration and the change the seller wants—not to deliver a long pitch.
2. Busy or Guarded Seller
“Hi [Name], [Your Name] with Achieve Realty. I know you may be hearing from several agents, so I’ll be brief. If you had a clearer strategy for the next attempt, would you still consider selling?”
If yes: “What is the one thing you would most want handled differently this time?”
Keep this version short. Its job is to earn a second conversation, not complete the listing appointment by phone.
3. Voicemail — Create a Reason to Call Back
“Hi [Name], this is [Your Name] with Achieve Realty. I reviewed the recent activity around your home and noticed a couple of things that may be worth discussing if selling is still on your radar. My number is [Phone]. Again, [Your Name] at [Phone].”
Do not put the entire sales pitch into voicemail. Give the owner a specific, credible reason to return the call.
4. Text Follow-Up — Only When Permitted
Use text only when your outreach is permitted under applicable consent, TCPA, state and brokerage requirements.
“Hi [Name], this is [Your Name] with Achieve Realty. I saw that your home recently came off the market. If selling is still part of your plan, I’d be glad to share a few observations from the recent market activity. Would a quick call be useful?”
Keep texts conversational and move meaningful discussion to a call or appointment.
5. Email — Property-Specific Value
Suggested subject: A few thoughts about your home in [Area]
“Hi [Name], I noticed your home recently came off the market. I reviewed the prior listing and nearby activity and identified a few areas I would want to examine before relaunching—pricing position, presentation, buyer response and current competition. If selling is still part of your plan, I’d be happy to walk you through what I would evaluate differently. Would a brief conversation this week be helpful?”
Replace generic claims with two or three observations specific to the property.
6. Letter or Mailer — Relisting Review
“I noticed your home recently came off the market without a sale. Rather than simply asking you to relist, I would like to offer a brief relisting review: how the home was positioned, how buyers responded, how the competition has changed and what I would adjust before returning to market. If selling is still important to you, I’d be glad to prepare that review with no obligation.”
Use a professional Achieve-branded piece and make the next step obvious: phone, email or a short consultation.
7. Follow-Up After the First Conversation
“Hi [Name], it’s [Your Name] with Achieve Realty. I wanted to follow up on our conversation after your home came off the market. Have you decided to pause completely, or are you still evaluating what a better relaunch would need to look like?”
If they are still open: “What would you need to see in a new plan before you would feel comfortable interviewing another agent?”
Follow up with new value—market changes, a relevant sale, a pricing observation or a relisting idea—not repeated “just checking in” messages.
8. “We Had a Bad Agent”
“I’m sorry the experience was disappointing. I wasn’t part of that relationship, so I don’t want to criticize anyone or make assumptions. What I can do is look at the market response and the strategy. If you were to relist, what would you most want handled differently?”
Principle: Never win trust by attacking the prior agent. Redirect the conversation toward the seller's expectations and your plan.
9. “We’re Not Selling Anymore”
“I understand. After going through the process, taking a break can make sense. Did your reason for moving change, or are you mainly stepping back because the last attempt was frustrating?”
If the move is truly off, thank them and respect the decision. If the goal remains, ask permission for a future follow-up rather than pushing for an immediate appointment.
10. “We’re Going Back With the Same Agent”
“I understand. Have you already signed a new listing agreement, or are you still deciding on the next plan?”
If a new agreement is signed, end the prospecting conversation professionally. If it is not, and contact is otherwise permitted, ask whether they would find value in seeing an alternative strategy before making a final decision.
11. Convert the Conversation to a Consultation
“Based on what you’ve told me and what I saw in the market activity, I think there are several areas worth reviewing before the home goes back on the market. I’d like to show you the pricing position, presentation changes, marketing plan and feedback process I would recommend. Would [day/time] or [day/time] be better for a 20-minute review?”
Offer a focused relisting consultation, not a generic listing presentation.
12. Before You Call — Property Review Checklist
- Confirm current listing status and expiration/cancellation date.
- Verify ownership and permitted contact information.
- Review original price, reductions and days on market.
- Compare active, pending and recently sold competition.
- Review photos, copy, presentation and showing access.
- Identify two or three possible causes of weak buyer response.
- Prepare one property-specific observation before dialing.
- Record outreach attempts, responses and opt-out requests in the CRM.
13. Role-Play Drill
Partner with another Achieve agent. One person plays the seller; the other must reach these four objectives without sounding scripted:
- Confirm whether the seller still has a reason to move.
- Discover what disappointed them about the prior attempt.
- Offer one property-specific insight.
- Ask for a short relisting consultation.
Rotate objections: “I’m getting too many calls,” “We’re taking a break,” “It was the market,” “We’re using the same agent,” and “We won’t reduce the price.”
14. Additional Expired Listing Training
Use these publisher resources for additional study. Achieve Realty University does not reproduce their copyrighted scripts.

FSBO Scripts
Achieve Realty conversation frameworks adapted from proven FSBO prospecting principles: keep it short, respect the seller's decision, lead with value, and earn the next conversation.
1. First Call — Keep It Super Short
Greeting & acknowledgement:
“Hi [Name], this is [Your Name] with Achieve Realty here in [Town/Area]. How are you? I’ll keep this really short—I know you’re probably getting plenty of calls from agents.”
Compliment & curiosity:
“I saw your home on [site/platform]. The [specific feature] really stood out. Are you still actively showing it, or have you already found a buyer?”
Align & empathize:
“I understand why an owner would want to try selling on their own and keep more control over the process. How has the interest been so far?”
Offer & ask:
“If you’re open to it, I’d love to stop by for 10–15 minutes to see the home in person. If I’m working with or come across a buyer who may fit, I’ll have a better sense of the property. Either way, I can give you a little feedback from an agent’s perspective. No obligation.”
Scheduling:
“I’m available [day/time range]. What works best for you?”
Achieve principle: The first call is not a listing presentation. Your goal is to reduce resistance, learn what is happening, and earn permission for the next step.
2. Busy or Guarded Seller
“Hi [Name], this is [Your Name] with Achieve Realty. I know you may be getting a lot of agent calls, so I’ll be brief. I saw your home for sale in [Area] and wanted to ask one quick question: how is the response going so far?”
If they sound open: “What would need to happen for you to feel like the FSBO route is working the way you hoped?”
If they are rushed: “No problem. If you’d ever like a quick pricing, buyer-feedback, or net-proceeds second opinion, I’m happy to help without getting in the way of your plan.”
3. Voicemail #1 — Quick Heads-Up
“Hi [Name], it’s [Your Name] with Achieve Realty here in [Town/Area]. I noticed your FSBO on [site]. I’ll be in the area on [day] and would be glad to take a quick look at the property—no listing pitch, just a short preview so I understand the home if I have a buyer match. I’ll send you my contact information as well. Call me at [Phone] if that would be useful.”
Use: When the main objective is simply to get on the seller’s radar without sounding like another listing solicitation.
4. Voicemail #2 — Net Sheet / Market Value
“Hi [Name], this is [Your Name] with Achieve Realty. I took a quick look at your asking price and nearby sales. If it would help, I can prepare a simple seller-net estimate and market comparison so you can see the numbers behind the asking price and likely costs. No strings attached. Call or text me at [Phone] if you’d like me to send it over.”
Use: When you can offer something tangible and useful without asking for a listing appointment.
5. Voicemail #3 — Buyer Interest Check
Only use this angle when it is truthful.
“Hi [Name], this is [Your Name] with Achieve Realty. I’m working with a buyer in your general price range who is focused on [neighborhood/feature]. I’d like to preview your home so I can tell whether it may be worth showing them. If it isn’t a fit, I’ll still be glad to give you a couple of quick observations about what buyers are responding to right now. You can reach me at [Phone].”
6. Voicemail #4 — Friendly Resource
“Hi [Name], it’s [Your Name] again with Achieve Realty. I know selling by owner can involve a lot of moving parts, so I have a short seller checklist covering showings, buyer qualification, paperwork, and transaction steps. If you’d like a copy, just call or text me at [Phone] and I’ll send it over.”
Voicemail rule: Keep it brief, sound conversational, and give the seller one clear reason to respond.
7. Text #1 — Friendly Local Agent
Use only when texting is permitted.
“Hi [Name], it’s [Your Name] with Achieve Realty. I saw your FSBO on [site]—the [specific feature] looks great. Hope you don’t mind me reaching out. How has the interest been so far? If you ever want a quick market update, pricing perspective, or seller resource, I’m happy to help. No pressure.”
Why it works: Specific, personal, easy to answer, and not built around an immediate listing pitch.
8. Text #2 — Possible Buyer Angle
“Hi [Name], this is [Your Name] with Achieve Realty. I work with buyers in your general price range and area. I’d be glad to preview your home so I can speak accurately about it if there’s a potential match. No listing pitch—just a quick look and, if useful, a little buyer feedback. Let me know if that would be helpful.”
Truthfulness rule: If you do not have a specific buyer, do not say that you do. Use accurate language such as “buyers in this market” or “buyers in this price range.”
9. Email — Net Sheet / CMA Offer
Suggested subject lines: “Your FSBO net sheet,” “A quick market check for [Neighborhood],” or “What to look at when an offer comes in.”
“Hi [Name],
I saw that you’re selling your home on your own. One area that often becomes more complicated than expected is comparing offers based on the complete result—not just the price. Closing costs, contingencies, financing strength, repair requests, concessions, and timing can all affect what you ultimately net.
If you’d like, I can prepare a brief Comparative Market Analysis and seller-net estimate based on your asking price and recent nearby sales. There is no obligation to list with me. It is simply information you can use while you work your FSBO plan.
Would you like me to prepare one?
[Your Name]
Achieve Realty”
10. DM #1 — Compliment & Quick Tip
“Hi [Name], I saw your home on [Marketplace/Instagram/etc.]. The [specific feature] really stood out. I’m a local Achieve Realty agent. If you’d ever like a couple of quick ideas on pricing, presentation, or what buyers are reacting to right now, I’m happy to share them. No strings attached.”
11. DM #2 — Buyer / Preview Angle
“Hi [Name], I’m [Your Name] with Achieve Realty. I work with buyers looking in this general area and price range. Would you be open to a quick preview so I can understand the property better? Even if it isn’t a match for someone I’m currently working with, I’d be glad to leave you with a couple of useful market or marketing observations.”
12. DM #3 — Resource Share
“Hi [Name], congratulations on putting your home on the market. I have a short FSBO checklist that covers showings, buyer qualification, paperwork, and transaction steps. If you’d like it, I’d be happy to send it over. No pressure.”
13. DM #4 — Follow-Up Ping
“Hi [Name], just following up on the note I sent about your FSBO. If you’re all set, that’s great. If you’d like a quick pricing review, seller-net estimate, or second opinion on buyer activity, I’m happy to help.”
Boundary rule: If the seller does not engage after a reasonable number of touches, give them space and respect their preferences.
14. Personalized Video Outreach
Keep the video around a minute and use a simple five-part outline:
- Greet by name.
- Mention one specific feature you noticed in their marketing.
- Acknowledge their FSBO decision without criticizing it.
- Offer one useful next step—a preview, market snapshot, seller-net estimate, or feedback.
- Close simply: “Reply whichever way is easiest for you.”
Achieve tip: Natural beats overproduced. The objective is to appear credible, local, and helpful—not scripted.
15. “I Don’t Want to Pay Commission”
“I understand. Saving money is one of the biggest reasons owners choose to sell on their own. I’m not asking you to change that today. What I can do is help you compare the full numbers—price, concessions, closing costs, financing strength, negotiation, and net proceeds—so you can decide which path gives you the best outcome.”
Pivot: “Would it be useful if I showed you both scenarios side by side?”
16. “If You Have a Buyer, Just Bring Them”
“Absolutely. The best first step is for me to preview the property so I can describe it accurately and avoid wasting your time or a buyer’s time. Would [day/time] or [day/time] work better?”
If you do not have a specific buyer, say so honestly and position the preview as preparation for future buyer matches.
17. “We Already Have Interest From Several People”
“That’s great—I hope one of them turns into a strong offer. If anything stalls or the offers aren’t as strong as expected, I’m happy to help you look at the terms, financing, or next options. Would it be alright if I checked back with you next week?”
18. “We’re Just Testing the Market”
“That makes sense. If you’re testing the market, the most useful thing is having something objective to compare against the response you’re getting. I can send you a quick snapshot of recent competing and sold homes in the area if that would help.”
19. “We Have an Agent Friend If We Decide to List”
“That’s good—you already have someone you trust. If you ever decide you want to compare strategies before making a final decision, I’d be glad to show you how I would approach the property. In the meantime, I’m happy to be a local resource if you need market information.”
20. In-Person FSBO Preview
A preview is your opportunity to move from stranger to trusted resource—not to ambush the seller with a full listing presentation.
- Ask about the home’s history and improvements.
- Ask what attracted them to the neighborhood and what buyers have commented on.
- Learn their motivation, timeline, and ideal outcome.
- Offer one or two useful observations rather than a long critique.
- Ask permission to follow up after they have more market feedback.
Suggested positioning: “I’m here to help you sell your way. If at some point you want more help, I’ll be glad to show you what I would do differently.”
21. What Not to Say at a FSBO Preview
- “I have a buyer”—unless you genuinely do.
- “You’re priced wrong”—before you have reviewed the data.
- “Let me take over”—before you have earned trust.
Instead, ask two or three good questions, offer one useful suggestion, and propose one simple next step.
22. Follow-Up Text
Use only when permitted.
“Hi [Name], [Your Name] with Achieve Realty checking in. How is the FSBO going? If you want a fresh set of eyes, quick market update, or seller-net review, I’m around. If everything is going well, that’s great too.”
23. Follow-Up Email
Subject: How is the FSBO progressing?
“Hi [Name],
I wanted to check in and see how things are going with the sale. If you’re happy with the activity, that’s great. If you’re feeling stuck, want more exposure, or would like a second opinion on pricing, offers, or buyer qualification, I’m happy to help.
Either way, I wish you the best with the sale.
[Your Name]
Achieve Realty”
24. The “No-Strings-Attached” Help Strategy
Do not make every touch about earning the listing. Give the owner small pieces of real value first: a market snapshot, seller-net worksheet, staging observation, offer-review checklist, buyer-financing question, or transaction resource.
The goal is to become the professional they remember when they eventually need more help.
25. When the Seller Is Hostile or Fed Up With Agents
“It sounds like you’ve had a lot of agents calling, and I understand why that would be frustrating. I’m not here to pressure you. I simply wanted to let you know I’m available if you ever need a market question answered or a second opinion. If you’d rather I not follow up, just tell me and I’ll respect that.”
Rule: Do not try to “win” a hostile conversation. Respect the boundary and protect your reputation.
26. Tracking & Follow-Up Schedule
Tag each prospect as FSBO in the CRM and record the date, last contact, seller motivation, current activity, objections, and the value angle that created the best response.
- Somewhat open: consider a meaningful follow-up roughly every 10–14 days, adjusted to seller engagement and applicable contact rules.
- Cold: give more space—often 21–30 days or longer may be more appropriate.
- Vary the touch: phone, email, permitted text, market update, handwritten note, or useful resource rather than repeating the same pitch.
Always stop when the seller asks you to stop.
27. Role-Play Drill
Practice the complete progression rather than memorizing one script:
- Keep the opening short.
- Use one sincere compliment or property-specific observation.
- Ask how the FSBO is going.
- Respect the seller’s reason for selling independently.
- Offer one useful resource or preview.
- Handle one objection without arguing.
- Earn a specific next step.
Rotate scenarios: commission, “bring me a buyer,” “we already have interest,” “we’re testing,” “we have an agent friend,” and “stop calling.”
28. Additional FSBO Training
